Berg’s Limited Warranty Policy
Berg Company (BERG) provides Limited Warranty on all of its control system products and/or part(s) (including all pieces and pourers) for a period of one (1) year from the warranty period start date. During the Limited Warranty period, Berg will repair or replace, at no charge, products and/or part(s) of a product that prove defective because of improper material or workmanship under normal use and maintenance. This Limited Warranty is not assignable and is only for the benefit of the original Dealer. Berg neither assumes nor authorizes anyone to assume, on its behalf, any obligations not covered by this Warranty.
WARRANTY PERIOD START DATE
The warranty period start date shall be either the original ship date or, if Berg receives a properly submitted Berg Warranty Card, the warranty period start date will be the installation date recorded on that card. To be considered properly submitted, the Berg Warranty Card must be filled out completely and received at Berg within 90 days of the original ship date or within 10 days of the installation date recorded on that card.
CONDITIONS AND EXCLUSIONS
Any defect (failure) caused by misuse, abuse, improper installation, lack of normal care or maintenance, accident, or Act of God is not covered by the Limited Warranty. Any modification made to a product and/or part renders Berg’s Limited Warranty null and void. Only a Dealer can make a warranty claim to Berg. Further, Berg makes no express or implied warranty to the original Dealer that the goods sold hereunder are compatible with any specific drivers, software or programming products, whether embedded or otherwise. The warranty contained herein is expressly in lieu of any other express or implied warranty, and Berg expressly disclaims any implied warranty of merchantability or fitness for a particular purpose, or any warranty as to patent or copyright infringement or the like, or any other obligation not set forth herein.
WARRANTY PROCEDURE
In order to return any product and/or part(s) claimed to be under the Limited Warranty, the original purchaser shall request a Return Material Authorization (RMA) number from Berg and ship the product and/or part(s) to Berg, including the RMA number marked clearly on shipping label and inside of the box. Following receipt of the returned product and/or part(s), Berg will make the determination as to the validity of the claim.
Products and/or part(s) returned with RMA within 30 days of the warranty period start date may be replaced at the request of the Dealer before receiving the return of the claimed defective item. If Berg subsequently determines that the returned item(s) are not defective and still suitable for intended use, the product and/or part(s) will be returned to the original Dealer and the product and/or part(s) that were shipped in advance will be charged to the Dealer at the standard price.
Equipment returned with an RMA in 30 to 90 days of the warranty period: Berg will determine the validity of the warranty claim upon receipt of the equipment. Loaners requested will be charged against the dealer account and the charges will be remover upon the timely return of the loaner equipment. Timely return is defined by “30 days or less” from the return of the repaired equipment by Berg. Equipment not returned within the 30 day time frame will be considered purchased by the dealer and full payment of the invoice amount will become due in full at that time.
For products and/or part(s) returned with RMA beyond 90 days of the warranty period start date, Berg shall determine the validity of the claim upon receipt. If “loaners” are requested, there will be a non-refundable $200 charge for each major component, in addition, the Dealer price of the loaner product will be charged to the Dealer’s account. For those products and/or parts that are determined by Berg to be defective, Berg will repair or replace the product and/or part(s) and ship to the original Dealer and the loaner product, if returned, will be credited to the Dealer account.
FREIGHT CHARGES
Berg is responsible for freight charges associated with claims it has determined are valid for products and/or part(s) returned with RMA within 30 days of the warranty period start date. All other freight charges are the responsibility of the original Dealer.
